TERMS AND CONDITIONS OF USE

This License Agreement governs your use of the images provided by Bersoft Inc.

THESE TERMS AND CONDITIONS OF USE CONSTITUTE A LEGAL AGREEMENT BETWEEN YOU AND BERSOFT INC.

Ownership of This Website

All rights to the Image(s) accompanying materials (if applicable), including without limitation, copyright and all other rights, are retained by Bersoft Inc.

Condition of Images.

You agree to carefully examine each Image or scan for physical defects before use or reproduction. NEITHER BERSOFT INC. NOR ITS AFFILIATES SHALL BE LIABLE FOR ANY LOSS OR DAMAGE TO YOU OR ANY THIRD PARTY ARISING FROM ANY PHYSICAL DEFECT IN ANY IMAGE, CAPTION OR SCAN IN CONNECTION WITH USE OR REPRODUCTION.

We reserve the right to change these Agreement and Terms and Conditions of Use pricing, information and available contractual license terms featured on this website without notice. These conditions set out the entire agreement between Bersoft Inc. and you relating to your use of Bersoft.Org. If you do not wish to be bound by this Agreement, do not accept this Agreement and do not use this site or download or use any Images.

You may not remove any copyright or other proprietary notices contained in the Images, caption information, or any other material on this site.

Despite our efforts to provide accurate information, this site may contain technical or other mistakes, inaccuracies or typographical errors.

 

Licences

1. Royalty Free

Bersoft Inc. offers Royalty-Free, that grants you a non-exclusive, non-transferable right to use solely in. Royalty Free Images are purchased outright, either as single images or on disc volumes in bulk, and can be used any way you want, with certain restrictions:

Permitted Uses. You may:

  1. Back up, copy, or archive the Image(s) as necessary for internal use, and only as necessary for that use. Any copy or archive you make must include the Image's copyright: Bersoft Inc.
  2. Use the Image(s) in any electronic or print media, including advertising and editorial use, and consumer merchandise.
  3. Use the Image(s) for any items for resale, including book covers and consumer merchandise, provided these products are not intended to allow the re-distribution or re-use of the Image(s).
  4. Modify or alter the Image(s) as necessary for your use, as allowed for elsewhere in these terms and conditions, provided that the rights to any derivative work shall belong to Bersoft Inc. You may use such derivative work only as permitted in accordance with these terms and conditions. All copyrights with respect to such derivative work are assigned to Bersoft Inc. You must include the Image's copyright: Bersoft Inc.
  5. In the normal course of workflow, convey to a third party temporary copies of the Image(s) that are integral to your work product and without which the product could not be completed.

    6. Prohibited and Restriction Uses. You may not:

  6. Images are licensed with no rights protection on a non-exclusive basis. Except as permitted in writing, you may not prepare derivative works or composite images; or license, sublicense or transfer any right to any Image. You shall not acquire any right, title or interest to any Image, CD or portion thereof, except as expressly granted in writing. All other rights are reserved by Bersoft Inc.
  7. Reverse engineer, decompile, or disassemble any part of the Image(s), CD-ROM or accompanying materials (if applicable), subject to applicable law.
  8. Copy or reproduce the Image(s), CD-ROM or accompanying materials (if applicable), except as specifically provided for in paragraph (1a).
  9. Remove any copyright or trademark from any place where it appears on the Image(s) or its accompanying materials.
  10. You may not use any Image in any manner, or in connection with any material, that is unlawful, defamatory, obscene, pornographic or that infringes any trade or service marks, rights of privacy or publicity, or other rights of third parties.
  11. Display the Image(s) in any digital format or for any digital use at a resolution greater that you purchase. Doing so will be viewed as an attempt to distribute the Image(s) in violation of this Agreement. We are specifying this so that no one can steal the Image(s) from you, even if that was not your intention.
  12. Use the Image(s) or any part of it as part of a trademark, service mark, or logo. Bersoft Inc. retains the full rights to the Image(s), and therefore you cannot establish your own rights over any part of it.
  13. Re-sell, distribute or sub-license the Image(s), CD-ROM (if applicable), or the rights to use the Image(s) to anyone for any purpose, except as specifically provided for elsewhere in this agreement. Bersoft Inc. is in the business of licensing images to its customers. It is the specific intent of this provision to prohibit a purchaser or licensee of Bersoft Inc.’s images from using the Image(s) to enter, either directly or indirectly, a similar or competing business. It is also prohibited to use the Image(s) in a product whereby the purchaser or licensee of that product can then use the Image(s) for its own purposes.

2. Right Managed

  1. IMAGES are "rented" for a specific purpose at a specific price. The price of the picture is determined by how you want to use the picture. Bersoft Inc. will grant you a non-transferable license strictly limited to the Invoice’s express terms and conditioned upon your acceptance of all the terms of the Agreement; your obtaining all necessary releases and permissions; and your timely payment of all fees.
  2. Permission to utilize image(s) is only granted for the use specified on the face of the invoice and for no other purpose, including promotional and/or electronic usage. Permission is only effective after you pay the invoice and no rights are granted by your possession of the image(s) or the invoice.
  3. You agree not to use the image(s) in any way that could be considered defamatory, pornographic or fraudulent, either by making physical changes to it, or in the juxtaposition to accompanying text.
  4. You agree not to make, authorize or permit any use of an image or its derivative (use of an image as source to create another image) except as authorized by the invoice. In the event you utilize an image for any use other than that indicated on the invoice, including but not limited to the number of uses, the publication utilized, or the size of reproduction.
  5. You agree not Re-sell, distribute or sub-license the Image(s).
